1. Agreement to Terms

By accessing or using the CyberCAAT (Cybersecurity Assessment & Auditing Technology) platform operated by Transformyx Technology Services, LLC ("Transformyx," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

2. Description of Service

CyberCAAT is a comprehensive cybersecurity assessment and compliance management platform that provides:

• Risk assessment and scoring capabilities
• Compliance framework mapping and tracking
• Vulnerability management and monitoring
• Security awareness training metrics
• Breach detection and monitoring services
• Infrastructure scanning and analysis
• Reporting and analytics dashboards

3. Account Registration

3.1 Account Requirements

To use CyberCAAT, you must:

• Be at least 18 years old
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Have authority to bind your organization to these Terms

3.2 Account Security

You are responsible for all activities that occur under your account. You must immediately notify us of any unauthorized use or security breach.

4. Acceptable Use

You agree to use CyberCAAT only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the service to harm, threaten, or harass others
• Attempt to gain unauthorized access to any systems or networks
• Use scanning or monitoring features against systems you don't own or have authorization to assess
• Reverse engineer, decompile, or disassemble any part of the platform
• Share your account credentials with unauthorized parties
• Upload malicious code, viruses, or harmful content
• Violate any applicable laws, regulations, or third-party rights

5. Subscription and Payment

5.1 Fees

Access to CyberCAAT requires a paid subscription. Fees are based on your selected plan and are billed according to your subscription terms.

5.2 Payment Terms

• All fees are due in advance and are non-refundable except as required by law
• We may change our fees with 30 days' notice
• Failure to pay may result in service suspension or termination

5.3 Taxes

You are responsible for all applicable taxes. If we are required to collect taxes, they will be added to your invoice.

6. Intellectual Property

6.1 Our Rights

CyberCAAT and all related content, features, and functionality are owned by Transformyx and are protected by intellectual property laws. The CyberCAAT name, logo, and all related marks are our trademarks.

6.2 Your Content

You retain ownership of data and content you upload to CyberCAAT. You grant us a limited license to use this content solely to provide and improve our services.

6.3 Feedback

Any feedback, suggestions, or ideas you provide may be used by us without obligation or compensation to you.

7. Data and Privacy

Our collection and use of your information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

8. Third-Party Services

CyberCAAT integrates with third-party services including:

• Have I Been Pwned (HIBP) for breach detection
• Shodan for infrastructure scanning
• NIST and other compliance frameworks
• Security news and threat intelligence feeds

Your use of these integrations is subject to the respective third-party terms and policies.

9. Disclaimer of Warranties

CYBERCAAT IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• The service will be uninterrupted, secure, or error-free
• All vulnerabilities or security issues will be detected
• Assessment results will be complete or accurate
• The service will meet your specific requirements

You acknowledge that no security solution provides absolute protection and that CyberCAAT is a tool to assist, not replace, professional security judgment.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRANSFORMYX SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or business opportunities
• Security breaches or incidents that occur despite using our services
• Third-party claims arising from your use of the service

Our total liability shall not exceed the amounts paid by you in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Transformyx and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of CyberCAAT
• Your violation of these Terms
• Your violation of any third-party rights
• Unauthorized scanning or assessment activities

12. Termination

Either party may terminate this agreement at any time. Upon termination:

• Your access to CyberCAAT will be revoked
• You may request export of your data within 30 days
• We may delete your data after the retention period
• Provisions that by their nature should survive will remain in effect

13. Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes via email or through the platform. Your continued use after changes constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of the State of South Carolina, without regard to conflict of law principles. Any disputes shall be resolved in the courts of South Carolina.
